Ethical Dilemmas Associated with Corporate Bribery free essay sample
Ethical Dilemmas Associated With Corporate Bribery ABSTRACT In todayââ¬â¢s business world, bribery has become an everyday problem. Some people consider it to be a fair business tactic, others consider it to be an unethical act. This paper focuses on a particular bribery case and uses three different ethical theories, Utilitarianism, Kant, and virtue ethics to determine whether or not bribery is an ethical or unethical act. The Case A former partner of a prominent New Jersey law firm has been indicted on bribery charges in exchange for legislation and other favors intended to benefit the attorneyââ¬â¢s land-developer clients. Eric Wisler is charged with making regular payments to Democratic, New Jersey Senator Wayne Bryant totaling $192,000 from 2004 to 2006. Currently, Wisler faces a total of 37 counts of mail and wire fraud, as well as one count of offering a bribe. The stakeholders in this case involve a large scope of individuals and businesses. We will write a custom essay sample on Ethical Dilemmas Associated with Corporate Bribery or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page Eric Wisler, Wislerââ¬â¢s land developer clients, and Senator Bryant were the biggest stakeholders in this case. However, there certainly were many more affected by these illegal acts. All other land-developers and stockholders were unknowing stakeholders. They were losing business as a direct result of not participating in bribery. Other stakeholders in this case were lawyers and clients in Wislerââ¬â¢s law firm. Some people may also argue that all lawyers in general were stakeholders. Due to the unlawful actions of one lawyer, all other lawyers lose a hint of credibility as a result of this case. The same can be said with politicians. As a result of one Senatorââ¬â¢s criminal acts, peopleââ¬â¢s distrust of politicians builds. Utilitarian Consideration Utilitarianism is considered a teleological theory, meaning that the rightness of actions is determined solely be the amount of good consequences they produce. According to utilitarianism, morality is about producing good consequences, not having good intentions. The utilitarian argument is broken down into two distinct groups, rule and act utilitarianism. Act utilitarianism looks at the consequences of each individual act and calculates utility each time the act is performed. In order to determine if an act is ethical, the action must produce more hedons than dolors. In the case of Eric Wisler, the consequences do not demand that the rule should be broken. Before the scandal was uncovered by authorities, Wisler, Wislerââ¬â¢s land-developer clients, and Senator Bryant would have been identified as hedons. As a lawyer, Wisler was fulfilling his obligations to his land-developer clients, although illegally, by obtaining legislation to support their cause. Wislerââ¬â¢s land-developer clients would also be considered hedons in the scandal before it was revealed. The bribes were made in exchange for legislation and other favors intended to benefit this group of people. Lastly, Senator Bryant would have been recognized as a hedon. Over a two-year period, Bryant was able to accumulate $192,000 simply for influencing legislation. After this scandal was uncovered, all of these players were quickly categorized as dolors. The dolors in this case were other land-developers who were not clients of Wisler, Wislerââ¬â¢s law firm, businesses in the area, and politicians. Unfortunately, due to Wislerââ¬â¢s bribery other land developers who were not clients of his lost business. During 2004 and 2006, during Wisler and Senator Bryantââ¬â¢s arrangement, Wisler was a partner at DeCotiis, FitzPatrick Cole. Although the firm was not aware of the illegal activities, the practice has lost its credibility, causing them to lose a great deal of clients. Other businesses in the area are also potential dolors in this case. Some local businesses were hurt by the legislation passed by Senator Bryant and as a result, have not been as successful. Lastly, on a much broader scope, politicians in general can be considered dolors. Citizens have been known to be untrusting of politicians. This scandal gives people another reason be suspicious of them. When this case is analyzed before authorities uncovered it, there is a split between hedons and dolors. However, when it is studied after the scandal is revealed, it is hard to find any hedons in the case. The harm done as a direct result of the bribery, provides many dolors and very few, if any, hedons. In addition, the dolors in this case are greatly affected. Wisler faces jail time, Senator Bryant is currently serving a jail sentence due to accepting bribes, and the land-developers who were not clients of Wisler had lost business as a result of the bribery. An alternative to the situation would have been for Wisler to never offer bribes to Senator Bryant. When tilitarian calculus is performed on this situation, many more hedons emerge. Wisler would not be facing criminal charges, Senator Bryant would not be serving jail time for the bribes accepted from Wisler, and the land-developers who were not clients of Wisler would not be put at a disadvantage and would not lose business. The land-developer clients of Wisler are the only group of people who may be considered dolors if the brib ery had never taken place. As a direct result of the bribery, they had legislation passed in their favor and gained business over the competition. After looking at both situations, Wisler should have chosen not to offer Senator Bryant bribes. When the utilitarian calculus was done on the current situation, where bribes were offered and they were caught, the amount of dolors far outweigh the number of hedons. However, when looking at the available alternative to not participate in the bribes, there are many more hedons produced. In conclusion, act utilitarians would consider Wislerââ¬â¢s actions unethical. Rule utilitarianism looks at the consequences of having everyone follow a particular rule and calculates the overall utility of accepting or rejecting the rule. No one could approve a general rule that allows companies to use bribery to help further their agenda. The consequences of such a rule would be highly negative and would create a barrier to entry in the market because companies starting out would not have the funds to use bribery and would therefore not earn business. Act and rule utilitarians do not always agree with one another. Rule utilitarians claim that act utilitarianism can justify disobeying important moral rules and violating individual rights. In addition, act utilitarians take too much time calculating in each and every case. On the other hand, act utilitarians argue that by following a rule in a particular situation when the overall utility demands that we violate the rule is just rule-worship. In conclusion, act utilitarians believe that if the consequences demand it, the rule should be violated. Although, these two sides have their disputes, in the Wisler case, rule and act utilitarians are in agreement that bribery is unethical. Kantian Consideration The Kantian theory is deontological, meaning that people have a duty to perform certain acts not because of some benefit to themselves or others, ut because of the nature of these actions or the rules from which they follow. According to Kantââ¬â¢s views, moral obligation has nothing to do with consequences, but the motives of the person who carries out the action. In order to determine whether an action is ethical or unethical according to Kant three criteria should be analyzed, reversibility, universalizability, and respect/free consent. The first cr iterion for deciding if an action is ethical is the categorical imperative of reversibility. Reversibility means that if the situation were reversed, the person would be willing to be treated the same way. In the case of Eric Wisler bribing Senator Bryant in exchange for legislation and other favors for his land-developer clients, reversibility could certainly be used to show that this was an unethical decision. If Wislerââ¬â¢s land-developer clients put themselves in the reverse situation, they would not like losing potential clients to companies who were bribing officials to earn business. As a result, due to the categorical imperative of reversibility, corporate bribery is unethical. Universalizability is a second categorical imperative used to determining moral right and wrong. According to universalizability, if an act is deemed acceptable for one person, it is must be acceptable for all other relevantly similar persons in relevantly similar circumstances. In other words, universalizability enforces the belief that people must be consistent in the judgments they make. In regards to the case described above, the principle of universalizability would argue that it was an unethical decision simply because, I canââ¬â¢t imagine a world in which all business transactions were based on which company is offering the most enticing bribe. Lastly, according to Kantian arguments corporate bribery is unethical because it does not create a fair playing field. The companies that are not participating in bribery are not being treated with respect. Furthermore, these companies have not given consent to bribery. Therefore there is no moral right to engage in bribery. Instead people have a moral right to conduct business free from bribery, which creates the moral duty not to engage in these actions. According to every aspect of Kant, corporate bribery is unethical. The principle of reversibility proves that people participating in bribery would not want to reverse the situation and be put at a disadvantage. In regards to the principle of universalizability, there cannot be a world in which business transactions are based on which company is offering the most enticing briber. Lastly, people are disrespected by bribery and certainly do not provide consent to be financially hurt as a result of competitors participating in bribery. According to Kant, people must be treated as ends not means, unfortunately this is not the case when bribery is involved. Virtue Ethics While Utilitarianism and Kant deal with the rightness and wrongness of actions, virtue ethics focuses on what kind of person should an individual be. The concept of the ââ¬Å"golden meanâ⬠applies to virtue ethics. This concept involves choosing the middle ground between two extremes. A person who engages in bribery can be described as a cheater or as someone who does not play by the rules. These are vices, not virtues, Wisler possesses when it relates to his actions with Senator Bryant. Exemplifying these vices are not becoming of an upstanding individual, therefore, corporate bribery is unethical. Virtue ethics focuses on what kind of person an individual should be. It is easy to determine that according to this theory, bribery would be considered unethical. Conclusion Unfortunately, in todayââ¬â¢s society bribery has become a common practice in the business world. In nearly every case, more dolors than hedons are created. According to all three theories analyzed in this paper, Utilitarianism, Kant, and Virtue ethics, corporate bribery is unethical.

Extremely Loud and Insanely Close Writing Style Essay
Extremely Loud and Insanely Close Writing Style EssayWhen writing an essay, it's important to be aware of the extremely loud and incredibly close writing style. It's common for many writers to think that writing one is something easy to do, and that they don't have to learn to create a different sort of style that is almost similar to what is required in formal essays. But unfortunately, it's not as simple as that. As such, if you wish to avoid having your essay read or even mentioned on the internet, this is one step that you should not miss out on.The most important part about writing an extremely loud and incredibly close style essay is that you need to keep in mind that you're going to talk about something that interests you, and makes you happy. For example, when writing an essay about a certain subject, whether it's sports, music, movies, television, food, cooking, or anything else, you need to keep in mind that what you want to write will mean something to you. If you're going to write a specific type of essay about a certain subject, you might as well choose a very memorable phrase that you want to use.Writing an extremely loud and incredibly close style essay doesn't really mean that you're going to work hard at it. In fact, you should only be worried about being careful. However, this doesn't mean that you're going to go crazy and waste time writing the essay. There are several things that you can do while you're writing an essay. However, you should also remember that many people will only read it for the first time after it's finished. This means that you can't take your time, and neither can they. Therefore, you should also try to make your essay fast paced so that you can have something to talk about without too much delay. On the other hand, you need to make sure that your essay is extremely loud. This means that you're going to mention your topic as soon as possible. You can either add sentences at the end or else make an intro sentence. However, this will be your best bet if you're having trouble coming up with good phrases.Of course, if you want to make your essay very special, you can always make use of ellipses and bullet points. However, there are some parts of an essay that is quite boring and these can also be quite effective for doing the same thing. For example, if you want to write an essay about traveling, you can simply include all the interesting information that you have heard about it in between the bullet points and the ellipses. Therefore, you're guaranteed to get more attention.Indeed, writing an essay shouldn't be so difficult that you can't even finish it. This can only happen if you know how to make the most of your time. Be creative, and you'll be on your way to writing one of the most special essays you've ever written.

Getting Traction for Your Books â⬠by Justin Mares
Getting Traction for Your Books - by Justin Mares Getting "Traction" for Your Books - Interviewing Justin Mares ââ¬Å"Most startups don't fail at building a product. Most startups fail at getting traction.â⬠- Traction BookThe same can be said of books. Most authors donââ¬â¢t fail at writing a book, they fail at finding their readers and selling the book to them. This is why weââ¬â¢ve always stressed how authors and startups are similar, and how, when it comes to marketing, authors can learn al lot from startups. So today, we decided to bring some of the best startup marketing advice to the Reedsy blog: Justin Mares is the co-author of the Traction book, a bestseller and true reference work for early-stage startups planning their marketing strategy. As usual, the transcript of the most important points of the interview is provided below Hi Justin, itââ¬â¢s really amazing to have you on our Reedsy podcast. Youââ¬â¢re the co-author of the Traction Book, which I think is one of the very best marketing books for startups. For our listeners who donââ¬â¢t know about it yet, could you quickly give us the pitch?Sure! So Traction is a book that is there to help startups with the hard part of ââ¬Å"what do you do once you have a product?â⬠The book approaches how to go about setting up a growth process, how to figure out what channels are good for your business, and then has a chapter on each one of the 19 ââ¬Å"channelsâ⬠that we have identified as ways for a business to acquire customers. And youââ¬â¢re now releasing the second edition. Whatââ¬â¢s interesting is that you self-published the first one, and then got picked up by Penguin, howââ¬â¢s the experience been?Interestingâ⬠¦ Yes, itââ¬â¢s been interesting. Like anything, there are positives and negatives. On the positive side, the sec ond edition is in bookstores, it has been professionally edited, it is a lot crisper, we did a bunch more iterations and stuff like that, so itââ¬â¢s a really good book.On the negative side, things move a lot more slowly, and you lose some of the creative control that you have when youââ¬â¢re self-publishing a book.So on balance, I think it was the right decision, weââ¬â¢re really happy with Portfolio (Penguin), itââ¬â¢s been a great experience working with them, but there certainly are some positives and negatives.Thatââ¬â¢s really interesting, and I can definitely understand why, coming from a startup and tech background, you would find traditional publishing slow. Now, on another note, I like to think that authors are a little bit like startups, and that they should approach marketing in the same way we do. Would you agree with that?Definitely. And thatââ¬â¢s something we mention in our book: if you approach things in a systematic way - that we talk about in our book- you are far more likely to have things work out. And we found that applying that process we describe in the book to our own marketing of the book had the same impact and allowed us to do really well. And thatââ¬â¢s why I usually recommend authors to read the Traction book and use the approach you describe. Now, just quickly for our readers, could you sum up that approach?Sure! So what we talk about is basically: look at the potential channels (ways) you could market the book, and then figure out, if you want to sell, say, 5000 copies, which of these channels is going to allow you to sell that number of copies. [Read more about the ââ¬Å"bullseyeâ⬠approach here] Look at the potential ways you could market your book and test the ones that make most sense. So in our case we looked and we said: ââ¬Å"ok, we think email marketing is going to work well, we think doing blog guest posts is going to work well, and we think podcasts will work wellâ⬠. Once we figure that out, we ran small tests on each of these three channels. We measured them and saw that podcasts and email marketing far outperformed guest posting. So then we thought: great, letââ¬â¢s get on every potential podcast we can, get on every potential newsletter that has a relevant email list, and letââ¬â¢s just focus on those instead of doing all three of them in the hope that one will work (which is what a lot of people sadly do when it comes to marketing). This makes sense. And itââ¬â¢s interesting because, as you say, a lot of authors try to do everything at one time (social media, newsletter, advertising, blog tours, etc.) and when you do that, you lose focus and waste time and resources.Exactly. I mean, there are so many things you can do as an author, as a marke ter or as a business person to market your stuff. The possibilities are effectively limitless, so what you have to do is figure out what the best use of your time is, and spend as much time doing that as possible. Thatââ¬â¢s what our approach effectively tries to help people with: if youââ¬â¢re trying to sell your book, or grow your company, focus only on the things that really matter, and ignore everything else. That makes sense. The one thing that makes it a bit trickier for authors, is that often they sell their books through platforms like Amazon, iBooks or Kobo, which they donââ¬â¢t control. So how do you do the tracking in a case like this, how can you know which ââ¬Å"channelsâ⬠are bringing you which sales?Great question. This is something that is certainly a challenge, itââ¬â¢s not easy. But we found a couple of things you can do. For one, we could look at our rough sales rank and see, if we launch a certain campaign today, see what our sales rank does. The other thing you can do is set up Amazon affiliate links so that if someone promotes your book, you can give them a unique affiliate link that allows you then to see how many people clicked on the link and how many made a purchase as a result of it.That way we were able to track the number of people who bought through email promotions, through guest posts, through podcasts, etc.Yes, weââ¬â¢d heard the affiliate link t actic before (from Mark Dawson), so Iââ¬â¢m glad you mentioned it. Now, you had this non-fiction book that you marketed very well. If you had to put yourself in the shoes of a fiction author, which channels would you test first?Hmm, itââ¬â¢s a hard one. I think basic marketing principles can apply here, and youââ¬â¢ve got to ask yourself the right questions.First, who are the people who are most likely to enjoy or resonate with your book, and where are they hanging out? Then, how are these people finding out about new fiction books today? What are the bestselling indie authors in your genre and how did they do their early-stage marketing?I would look at all these things and see what you can replicate and what you canââ¬â¢t.I think that one thing that is really powerful in driving book discoverability today is still word-of-mouth. Would you agree with that?Oh definitely, Iââ¬â¢ve got 150 books on my reading list that have been recommended to meâ⬠¦So as an author, w hat can you do to help encourage or kickstart word-of-mouth?The biggest one is to write literally the best book that you could ever think of writing. One reason why I think Traction has done really well is that if you are someone who is working on a startup, I can legitimately recommend that book to you - even if I wasnââ¬â¢t one of the authors.I had coffee with someone four hours ago and he told me ââ¬Å"oh yeah, my friend is running growth at this one company and he said that Traction was a really good book, so he gave it to me and now Iââ¬â¢m meeting with youâ⬠. And that only happens when you write a really good book that becomes one of the reference works in its category.I think thatââ¬â¢s the #1 thing you can do for word-of-mouth. Otherwise, things that weââ¬â¢ve done is weââ¬â¢ve inserted little bonuses where after reading the book, you can go get bonus material on the website and once youââ¬â¢re signed up to our mailing list we have referral systems li ke ââ¬Å"forward this to a friend and weââ¬â¢ll give you another bonusâ⬠. 'To drive word of mouth, just write the best book you could ever think of writing.' @jwmares Thanks for the insights, Justin! And again, I really recommend the Traction book to both startup people and authors because it offers a good approach and a good breakdown of all the channels you can use to sell your books.Follow Justin Mares and Reedsy on Twitter: @jwmares and @ReedsyHQWhat channels have worked for you in your book marketing activities? Germany during WWII Essay Example | Topics and Well Written Essays - 1000 words
Germany during WWII - Essay Example World War I was seen as the main driving force behind strengthening of capitalism since it war economy was seen as the best way to "create a German Gemeinschaft in the service of the national welfare" (Feldman 1981: 164). However after suiffering defeat in the war, people became rather skeptic of capoitalsm and a need for reconstruction of induytsrial base arose. The traumatic Versailles Treaty further dampened the hopes for a more liberalized economy in Weimar Germany. According to the main proponents of capitalism, this system can survive where political economic stability is present. However this was not the case in Germany, especially not after the World War I though some relative peace was seen from 1924-1928. Still the conditions for prospering of capitalism were not present since the political structure of Weimar Republic was very fragile at the time. Despite this obvious problem, there was present in Germany, groups that wanted capitalism to exist and supported incorporation of large firms into economic system of the country. Such a step was however against common wisdom but since it was not possible to give up capitalism immediately, Germany continued with the system- much to everyone's surprise. The German Democratic party (DDP) was one such liberal political group. The other problem was the presence of weak Spcialist parties. The Socilaits parties did not have a strong agenda and their principles could be easily altered. Political considerations were thus more powerful than common economic wisdom. Weimar government was not wise in this sense and while it knew that capitalism could hurt the country, it didn't pay heed to the economic forces that govern economic climate. Sturmer best describes the political instability in these words: [T]here were in the Reichstag different kinds of majorities, namely a majority for the conduct of foreign policy, a majority for social policy, and majorities based on agrarian and industrial interests; but these majorities were mostly incompatible with one another. Consequently, with no solid majority in existence in the Reichstag, there was neither consistent government, nor consistent opposition (Strmer 1971: 62). It is important to understand why Weimar Republic still wanted a capitalist economy. It was not for the same reasons that rest of the Europe had adopted it. When economic situation reached an all time low in 1919 and millions of demoralized soldiers returned to Germany after the defeat, it was important to find a quick solution to the problem. Economic conditions may not have been as worse as they were in other countries but workers were still suffering and economy on the whole was fragile.
